The Supreme Court said it’s okay that Article 370, which gave special status to Jammu and Kashmir, was removed in 2019. They mentioned that Article 370 was not meant to be permanent and the President had the power to take it away. The court also told the government to organize Assembly elections in J&K by September 30, 2024.
The judges, led by Chief Justice D Y Chandrachud, explained that after Article 370 was removed, the special constitution for Jammu and Kashmir was no longer valid. They also supported the government’s decision to create Ladakh as a separate Union Territory from Jammu and Kashmir.
This decision came after petitions were filed against the government’s move in 2019 to remove Article 370, which led to the end of the special status of the region. Additionally, the government had passed a law to divide the state into two Union Territories – Jammu and Kashmir, and Ladakh.
The bench, which included Justices S K Kaul, Sanjeev Khanna, B R Gavai, and Surya Kant, made this decision unanimously.
